1.  Legality of Participation in Games and Limits of Use

No purchase is necessary to use play-for-fun casino games at Viva Macau. Viva Macau invites all consumers to use play-for-fun casino games free of charge and without betting money.

Viva Macau's operation of sportsbook, casino and poker room wagering ("Games") is directed only at individuals who are residents of jurisdictions, who under the laws of their home jurisdiction, are not prohibited from gambling on the Internet through the application of the software ("Players"). All wagers placed at Viva Macau are deemed to have been placed in Costa Rica.

Some jurisdictions have not yet addressed the legality of the use of software for gambling, while some jurisdictions have specifically made Internet gambling illegal. It is impossible for Viva Macau to determine the state of the law in every jurisdiction around the world on an ongoing basis. Therefore, Player accepts sole responsibility for determining the laws that apply in his/her jurisdiction. Player is responsible for any consequences that may transpire as a result of his/her not determining the legality of Internet gaming in his/her jurisdiction.

In compliance with the Unlawful Internet Gambling Enforcement Act, deposits and wagers will not be accepted from any US citizen or resident, or any person physically present in the United States of America. Player payments will not be sent to US addresses.

In order to participate in Games at Viva Macau, the individual must be at least 18 years of age or have reached the minimum legal age of maturity in his/her jurisdiction, whichever is greater. Minors are strictly forbidden to play Games.

The Player agrees that they do not find the Viva Macau website to be offensive, objectionable, unfair, nor indecent.

The Player agrees that they will play only for private and non-professional purposes. In the event that a Player is deemed to be a professional better, their account will be subject to immediate termination with any remaining account balances, including all deposits and winnings in Player's account, being returned to the Player. For purposes of this clause, winning wagers will only be paid on events that have been played prior to notice of account termination being sent to Player.

2.  Grant of License

Viva Macau hereby grants Player a personal, non-exclusive, non-transferable sub-license to use the software for playing Games at Viva Macau.

Commercial use of Viva Macau is strictly forbidden.

Player is only permitted one account regardless of the place or method Player accesses his/her account including any household, computer, or place of work. If Player is found to have more than one account, all winnings and bonuses will be void.

3.  Players Responsibilities

Viva Macau reserves the right to cancel Player’s membership, with or without cause, at any time, and without notice. Any balance in Player's account will be immediately paid to Player subject to the limitations of Section 3.

Viva Macau reserves the right, in its total discretion, to void any winnings and withhold any balance in Viva Macau account under any of the following circumstances:

• If the name on Player's Viva Macau account does not match the name on the credit card(s) used to deposit money into the account.
• If Player provides false and or misleading information to open a Viva Macau account.
• If Player is not of legal age in the jurisdiction where they reside.
• If Player resides in a jurisdiction where law prohibits the use and participation of Games.
• If Player is found to be a US citizen or resident or is found to have participated in Games at Viva Macau while present in the United States of America.
• If Player has allowed or permitted (purposely or not) another party to play on their Viva Macau account.
• If Player reverses or charges back any of their purchases on Viva Macau.
• If Player is determined, at Viva Macau's sole discretion, a professional better or part of any betting syndicate.

Player has the obligation to keep his/her private username and password secret and confidential. Any use of the software application through Player's username is the sole responsibility of the Player.

Player is obligated to prevent any third party or person, including and without limitation to any minor or US citizen or resident, to use his/her account to place wagers or participate in Games in any way.

The Player is fully responsible for any taxes and fees applicable to winnings resulting from participation in Games. If winnings are taxable in Player's jurisdiction, Player is required to keep track of and report the winnings to the appropriate authorities. Personal identity and details of all members will remain confidential. Viva Macau will not report wagering information on behalf of any member.

In the event that monies are credited to Player's account in error, it is incumbent upon Player to notify Viva Macau of the aforesaid error without delay. Any winnings obtained after the error, but prior to notification of Viva Macau, whether or not related to the error, shall be void.

4.  Indemnification

Before placing bets, Player is responsible for verifying the laws on gambling which governs the place where Viva Macau's Games are used.

Player shall hold the Company, its employees, officers, directors, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents and retailers harmless and blameless, and shall fully indemnify the same from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of Player's:

• entry, use, or reuse of the web site,
• use of any materials on the web site,
• entry, use, or reuse of the casino server,
• participation in the game, or,
• the acceptance of any prize.

5.  Abusive or Offensive Language

Abusive or offensive language will not be tolerated on chat boards, Games, or otherwise by Player on Viva Macau or with Viva Macau's staff. Viva Macau has the exclusive right to determine if any language is abusive or offensive.

Players are prohibited and agree that they will under no circumstances make untrue, malicious and/or damaging comments with regard to Viva Macau's operations in any media or forum.

Any violation of this policy will result in a suspension of playing privileges or such other actions including legal action for damages as may be reasonably required by Viva Macau to ensure compliance.

6.  Fraudulent Activities and Prohibited Transactions

If in Viva Macau's sole determination, Player is found to have cheated or attempted to defraud Viva Macau or any of the other users of Viva Macau's Games in any way, including but not limited to game manipulation or payment fraud, or if Viva Macau suspects Player of fraudulent payment, including the use of stolen credit cards, or any other fraudulent activity (including any chargeback or other reversal of payment) or prohibited transactions (including money laundering), Viva Macau reserves the right to suspend and/or close Player's account and to share this information (together with Player's identity) with other online gaming sites, banks, credit card companies, and appropriate agencies. Viva Macau may close any accounts, and forfeit account balances, that Player has at VivaMacau.com or at any other Viva Macau website, casino and/or business.

In the event of a Player disputing a credit card transaction made at Viva Macau.com as being unauthorized, or made in a 'card not present' environment, Viva Macau may charge an administration & recovery fee of up to $500 USD per disputed transaction if it is deemed by Viva Macau that the transaction was authorized and legitimate. Viva Macau may also engage the services of debt collection agencies to recover from Player the amount of any disputed transactions or chargebacks, administration and recovery fees, and other associated credit card processing fees or fines.

7.  Bonus and Free Money Abuse

Bonus and free money promotions are intended for recreational betters only. Professional players or players considered to be abusing the bonus system in any way whatsoever may have bonuses revoked and may be subject to further sanctions, as determined by Viva Macau's management. Bonus abuse includes, but is not limited to, clients cashing out for the purpose of redepositing, or claiming a bonus for a new account that they are themselves using. Sanctions may be in the form of increased rollover requirements, a loss of bonus privileges or termination of Player's account altogether.

8.  Periodic Review of Terms and Conditions

Player agrees that he/she shall periodically review at a rate not less than once monthly these Terms and Conditions posted at this Web site. Player shall not participate in the Games, open, use or reuse an account, enter the web site, or the casino, nor accept any prize if Player does not fully understand, agree to, become a party to, and shall abide by, without exception, all rules, regulations, terms and conditions contained herein and as such rules, regulations, terms and conditions as they may change from time to time.

9.  Deposits

Subject to the limitations of Section 9, there are no fees assessed to Player by Viva Macau for making deposits.

All deposits must be rolled over (wagered) at least once before cash out. In the instances where Viva Macau absorbs banking transaction fees, if the entire deposit amount is not rolled over at least once, any transfer charges associated with the deposit/withdrawal amount will be deducted from the account prior to the withdrawal [minimum five percent (5%)].

Deposits will be made available after Viva Macau has verified the receipt of funds. Processing times vary according to the payment method selected, but in general funds will be made available according to the following schedule:

• Visa / MasterCard - Immediately
• NETeller - Immediately
• MoneyBookers - Immediately
• Wire Transfer - 6 working days
• Mailed checks - up to 14 days

Viva Macau does not pay interest on customer deposits and is not responsible for foreign currency fluctuations. Amounts maintained in Player's cashier account will be maintained in the currency Player used to make his/her deposit.

Wagers in casino and sportsbook are quoted in Canadian dollars (CAD), Euros (EUR), British Pounds (GBP) and US dollars (USD) only, depending on Player's account settings. If the currency moved from Player's cashier account into their casino or sportsbook account is different from Player's preferred currency, Viva Macau will convert those funds into the preferred currency using the average Interbank exchange rate on the day Player initiates the transfer.

Wagers in the poker room are denominated in US dollars only. If the currency moved from Player's cashier account into their poker account is not USD, Viva Macau will convert those funds into USD at the average Interbank exchange rate on the day Player initiates the transfer.

If the currency used in Player's sportsbook, poker room or casino accounts is different than the currency used in his/her cashier account, Viva Macau will convert those funds at the average Interbank exchange rate on the day Player initiates the transfer.

Viva Macau does not assess fees to transfer funds between accounts or to convert currencies.

If you do not log onto your Viva Macau account for a period of 12 months, any balance in your Player's account will be forfeited to Viva Macau.

10. Withdrawals

Please note that the minimum withdrawal is $100 USD.

Before any withdrawal totaling more than $200 U.S. Dollars is authorized, a FVF (Fax Verification Form) must be properly printed, clearly filled out, and faxed to Viva Macau before any monies will be sent. Viva Macau reserves the right to request a FVF at any time and may terminate any account that does not satisfactorily complete and/or return the FVF in a time period determined as reasonable by Viva Macau. In such a case, Viva Macau may unilaterally determine resolution of any account funds.

Viva Macau reserves the right to withhold any amount in excess of the Player's original deposit from a Player's withdrawal if free money is wagered in blackjack, baccarat, roulette, or craps. Viva Macau reserves the right to refuse or rescind the free money for any reason including, but not restricted to, Bonus Abuse. In case of abuse, Viva Macau reserves the right to discontinue Player's membership and to prevent the Player from accessing Viva Macau in the future.

A maximum of $2,000 (Two Thousand US Dollars) will be sent per week, regardless of the total amount requested on a single or multiple withdrawal requests by the Player. Additional increments of a maximum of $2,000 will be sent each the following week(s) until all requested amounts have been paid.

Viva Macau may not refund Visa/MasterCard for an amount greater than the Player's deposit using his/her Visa/Mastercard. If Player requests a refund in excess of their Visa/Mastercard deposit,Viva Macau will refund their credit card for the amount of the deposit and the remaining funds will be wire transferred. Pursuit to section 10, Player's may be assessed both a credit card refund fee and a wire transfer fee for the withdrawal.

For players who have deposited using e-wallet solutions, any withdrawals will automatically be credited back to their e-wallet account where possible.

Due to increased security procedures, Players that have not previously received withdrawals via a selected method will be subject to extensive verification checks which may take up to 5-7 working days.

After your withdrawal request comes out of pending status, allow the following approximate times for payment:

• Mailed checks - up to 14 days
• Courier checks - 3 to 6 working days
• Wire transfer - 6 working days
• NETeller - 1 to 2 working days
• MoneyBookers - 1 to 2 working days

The following charges apply and will be deducted from a Player withdrawal under $1000 USD:

• Mailed certified checks - $10.00 USD
• Courier checks - $50.00 USD
• Credit card refund - $30.00 USD
• Wire transfer - $50.00 USD

Withdrawals of over $1000 USD will generally not be subject to the fees.

11. Payment Processing

Viva Macau uses advanced encryption systems to protect the username and password information, and any other delicate information transferred to and from the client application and Viva Macau servers, thus protecting Player and Viva Macau against manipulation attempts by a third party.

You agree that Viva Macau, or a payment processing company on its behalf ("Payment Processor"), will handle all financial account transactions. You hereby agree that Viva Macau and the Payment Processor reserve the right to withhold any payments should Viva Macau or the Payment Processor have reason to believe, or have any suspicion, that you may be engaging in or have engaged in fraudulent, collusion, unlawful, or improper activity.

You agree to fully pay any and all payments due to us or any third party in connection with your use of Viva Macau. You further agree not to make any chargebacks and/or renounce or cancel or otherwise reverse any of your due payments if you take any such action you will refund and compensate us for such unpaid payments including any expenses incurred by us in the process of collecting your payment.

12. No Warranties and Limited Liability

Player's access of Viva Macau.com, download of the Viva Macau software and participating in the Games is at Player's sole option, discretion and risk.

Viva Macau shall not be liable for computer malfunctions nor attempts by Player to participate in a game by methods, means or ways not intended by Viva Macau.

Viva Macau, the Games, and the Software are provided to Player "as is," without warranty of any kind, either express or implied, including but not limited to, implied warranties or merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement. Viva Macau does not warrant the functions contained in Viva Macau.com, the Games or the software will meet Player's requirements, nor that their operations will be uninterrupted or error free. The entire risk as to the use, quality and performance of Viva Macau.com, the Games and the software lies with Player.

Viva Macau Games are played over the Internet and all Players must accept the risk of disconnection. If a disconnection occurs (they can and do happen), Players should connect/log on and continue playing as soon as possible. At no time will Viva Macau assume responsibility for disconnections or disconnected Players, regardless of cause. To help limit the risk of possible disconnections Players should contact their internet service provider for advice.

Viva Macau's maximum liability to Player or any third party arising out of this agreement or Player's use of the software, whether for breach of contract, in tort or otherwise, will be limited to the amount, if any, Player directly paid to Viva Macau.

Viva Macau will not be liable for any direct, indirect, punitive, special, incidental or consequential damages in connection with or arising out of this agreement or Player's use of VivaMacau.com, the Games, or the Software, however they arise, whether for breach of contract or in tort, even if Viva Macau received prior notice of the possibility of such damage. In no event, shall Viva Macau be liable for any malfunctions of the software, bugs or viruses, resulting in lost data or any other damage to Player's computer equipment or software. Further, Viva Macau is not required to provide redundant or backup networks and/or systems.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Costa Rica, without giving effect to conflicts of law principles. The parties agree to submit to the exclusive jurisdiction of Costa Rica, for the settlement of any disputes arising out of or concerning this Agreement. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

14. Arbitration

Viva Macau will act as the final arbitrator for any dispute involving Viva Macau and any other party.

Viva Macau reserves the right to employ, at its sole discretion an arbitrator of its choice to act as an agent of arbitration in place of Viva Macau in the event of a dispute.

15. Severability

If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.

17. Entire Agreement, Modification and Amendments

Player fully understands and agrees to be bound by the terms and conditions contained herein and as modified and/or amended from time to time. Viva Macau reserves the right to modify and amend this Agreement at any time with or without notice. Such amendments will become effective immediately upon being posted at VivaMacau.com. It is Player's sole responsibility to review this Agreement and amendments hereto each time they play. The terms and conditions contained herein represent the complete and final agreement between the Player and Viva Macau and supersede any and all prior agreements, representations or statements made by Viva Macau.

Viva Macau. The software is protected under applicable copyright laws. Title, ownership and all intellectual property rights in the software remain with Viva Macau, including images, photographs, animations, video, audio, music and text that may be part of the software. Duplication, redistribution or publication of any of the content or part of the software is strictly prohibited. Title, ownership and all intellectual property rights in the name "Viva Macau" remain with Viva Macau, as the case may be. By installing and using this software, Player hereby agrees to have fully read and understood the above Terms and Conditions and so agrees to be bound by them.
