1.  Personal Information

For purposes of Viva Macau's Privacy Policy, "Personal Information" is considered to be any information used to identify an individual, including, but not limited to, first and last name, date of birth, credit card information, home or other physical address, email address, phone number or other contact information. Personal Information also includes contact information, shipping information, billing information, transaction history, web site usage preferences, and feedback regarding Viva Macau's products and services.

Personal Information does not include activity logs unique to Player that our servers keep as Player interacts with games, including: source IP address, time of access, date of access, web page(s) visited, language use, and type of browser used.

2.   Collection of Information

Viva Macau does not collect Personal Information about individuals on the site unless they provide it voluntarily. In general, individuals can visit Viva Macau without disclosing their personal identity and without revealing any Personal Information about themselves. No Personal Information is collected from individuals who only use Viva Macau's play for fun casino games.

Viva Macau collects Personal Information of individuals participating in Games. This is required for Viva Macau to grant access to Games and to deliver prizes or money to Player. Viva Macau may collect such Personal Information when Player provides such information through Viva Macau's Games or other communications and interactions with Viva Macau.

Viva Macau may receive Personal Information from online vendors and service providers that refer Players to Viva Macau. In addition, we may engage the services of third-party service providers to process Player's online transactions, provide technical support, and maintain Player's online accounts. Viva Macau will have access to any information Player provides to such vendors, service providers and third-party e-commerce services so that it can process Player's transactions, maintain Player's accounts, meet certain business requirements and provide Player with promotional offers and information regarding Viva Macau and its products and services.

From time-to-time, Viva Macau may request information from Player via surveys or contests. Participation in these surveys or contests is completely voluntary, and, therefore, Player has the choice of whether or not to disclose such information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level).

By accepting any contest prize or winnings from Viva Macau, Player consents to use of their name and likeness for advertising and promotional purposes, except where prohibited by law, without additional compensation.

Viva Macau tracks Player's transaction and wagering activity to protect both Player and Viva Macau.

Viva Macau collects e-mail addresses of individuals who communicate with Viva Macau via e-mail. When an individual submits a bug, suggestion, complaint, question, request, or any other e-mail correspondence, Viva Macau asks for their e-mail address so that they can receive a response.

Personal Information collected on Viva Macau's website may be stored and processed in any country in which Viva Macau or its affiliates, subsidiaries or agents maintain facilities. By using Games, Player consents to any transfer of information outside of Player's country.

3.   Consent to Use of Anti-Cheating Software

Viva Macau's software package, used to access and use Games contains certain features designed to detect use of automated programs that enable artificial (non-human) intelligence to participate in Games on Viva Macau. Use of such "bot" software programs violates Viva Macau's Terms and Conditions of Use, and is detrimental to other Players.

By opening a Viva Macau account and/or installing Viva Macau's software and/or using Games, Player consents to Viva Macau's software performing the functions described in this section. Viva Macau's software may perform any or all of the following functions in order to detect the use of illicit automated programs and ensure that it maintains a "cheat free" environment for all Players:

• scan Player's list of active software applications while you are using Games
• scan Player's list of active processes while Player is using Games,
• scan the files in Player's Viva Macau-related program folders to ensure that only "non-hacked" versions of VivaMacau's software are being used.

If any of the foregoing processes reveals a suspect application or process, Viva Macau's software may:

• scan the files associated with the suspect application or process and compile a composite mesh (i.e. a profile that characterizes the files associated with the application or process) to be matched against profiles for known illicit automated programs, and
• capture a screenshot of Player's desktop, and transmit it to Viva Macau for review.

Viva Macau's software does not perform any random search of large portions of Player's hard drive or other files, and will not transmit any information to Viva Macau or to any third party other than the information necessary to identify use of illicit automated programs.

Viva Macau's software does not alter any files or information on Player's computer, and will not interfere with the operation of any of Player's other applications.

Player may terminate use of Viva Macau's software at any time by uninstalling Viva Macau's software package and discontinuing use of Viva Macau's Games.

4.   Use of Information

Viva Macau uses the Personal Information it collects from Players to deliver the products and services they purchase, to provide customer support, to process any of Player's online transactions, to answer Player's questions, and for any other purpose related to the operation of Games and the programs, products and services offered at Viva Macau.

Player's Personal Information may also be shared with Viva Macau affiliates, subsidiaries or agents for technical support and to process transactions Player initiates on Games and deliver the products and services Player purchases.

Unless Player elects not to receive promotional information, Viva Macau may also use their Personal Information (including their email a ddress) to provide Player with information regarding Viva Macau's products, services and promotions.

Personal Information, as well as any other information collected in Games, may be disclosed to Viva Macau staff, affiliates and/or agents so that they can contact Player regarding Viva Macau's products, services, or promotional offers, respond to Player's requests, provide certain services to Player and operate Games.

5.   Certain Excluded Disclosures

Viva Macau may disclose Player's Personal Information as set out in our Terms and Conditions of Use, if requested to do so by legal authorities or required to do so by law, or if Viva Macau believes in good faith that such action is necessary to:

• conform to applicable laws or to comply with any legal process served on Viva Macau, the vivaMmcau.com website or the Games;
• protect and defend VivaMacau's rights or property; or
• act to protect the personal safety of users of Viva Macau or the public.

If Viva Macau should ever file for bankruptcy or be acquired by a third party, merge with a third party, sell all or part of Viva Macau's assets, or otherwise transfer substantially all of Viva Macau's relevant assets to a third party, it is entitled to sell or share the Personal Information and all other information Player has provided through Games to such third party.

Viva Macau will not sell, lease or share Player's Personal Information except as set forth in this Privacy Policy.

By registering an account, Player agrees that Viva Macau may display their Viva Macau username and game play records on the site.

Viva Macau may use Player's username to report amounts earned by others in participating in the Viva Macau affiliate or referral programs. This does not include your name, e-mail address, mailing address or any other Personal Information collected by Viva Macau.

From time to time, Viva Macau may ask Player to voluntarily provide permission to distribute general demographic and other personal information for inclusion on the Viva Macau "Winners" page. This information will not be released without Player's permission and Player is under no obligation to release this information to receive winnings or otherwise continue participation in Games.

Viva Macau uses cookies to track use of Games to help it improve Games and make it easier for Players to use. Cookies are small text files that are stored on the Player's computer when they visit certain web pages that record the Player's preferences. Players have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but if the Player prefers they can usually modify their browser setting to decline cookies. If Player chooses to decline cookies, they may not be able to fully experience the interactive features of the vivamacau.com website.

6.   Security

Viva Macau understands the importance of information security and the techniques needed to secure information. Viva Macau stores all of the Personal Information it receives directly from Player in a password-protected database residing within Viva Macau's secure network behind active state-of-the-art firewall software.

The Viva Macau website and Games support SSL Version 3 with 128 bit encryption.

7.   Access

Player's may confirm the accuracy of Personal Information Viva Macau has collected about them, or may update their Personal Information or delete their Personal Information, through the online cashier, through Viva Macau's customer service department or by contacting Viva Macau at any time by sending an email to cs@vivamacau.com.

Player complaints regarding the use of Personal Information may be sent through our customer service department or by email at legal@vivamacau.com.

If requested, Viva Macau will change any information Player has provided to it or mark any information to prohibit future use.

Players may "opt out" of receiving any promotional communications either by choosing to opt out where such option is made available on the vivamacau.com website or in the Games or in an email they receive from Viva Macau, or at any time by sending an email to cs@vivamacau.com.

8.   Third-Party Practices

Viva Macau cannot ensure the protection of any information or images that Players provide to a third-party website that links to or from the vivamacau.com website or any information collected by any third party administering Viva Macau's affiliate program or any other program, since these third-party websites are owned and operated independent of Viva Macau.

Any information collected by these third parties is not governed by this Privacy Policy but by the privacy policy, if any, of such third party. Player's questions about a third party's information practices should be directed at its privacy policy. Viva Macau assumes no responsibility or liability whatsoever for the practices, actions or policies of such third parties, and is not responsible for the content or privacy practices of such websites.

9.   Legal Disclaimer

The Games operate "AS-IS" and "AS-AVAILABLE," without liability of any kind. Viva Macau is not responsible for events beyond its direct control. Because of the complex and constantly changing nature of Viva Macau's technology and business, it cannot guarantee nor does it represent that there will be error-free performance regarding the privacy of Player's Personal Information, and Viva Macau will not be liable for any indirect, incidental, consequential or punitive damages relating to the use or release of Personal Information.

10.   Consent to Privacy Statement

By using Viva Macau and the Games, Player agrees to this Privacy Policy. This is the entire and exclusive Privacy Statement and it supersedes any earlier version. Viva Macau's Terms and Conditions of Use take precedence over any conflicting provision of this Privacy Policy. Viva Macau may occasionally update this Privacy Statement and encourages Players to periodically review this Privacy Policy. Player's continued use of the Games constitutes Player's agreement to this Privacy Policy and any updates.
